Man assaulted at state school

AUSTIN (AP) - A 23-year-old resident of a state facility for the mentally retarded and developmentally disabled was in critical condition after another male resident sexually assaulted him, police said Monday.
The assault occurred this weekend in a communal shower area at the Austin State School, said Sgt. Brian Loyd, with the Austin Police Department's sex crimes unit.
The victim has physical and cognitive disabilities and is also mute. He was in critical but stable condition at Seton Hospital, Loyd said in a story posted online Monday by the Austin American-Statesman.
No charges have been filed against the suspect, a man in his 20s who remains at the Austin State School, police said.
"An incident did occur at the Austin State School this past weekend and was promptly reported per policy to Texas Department of Family and Protective Services," Laura Albrecht, a Department of Disability and Aging Services spokeswoman, wrote in an e-mail.
It was unclear whether staffers were supervising the suspect more closely. The Department of Disability and Aging Services would not provide additional information.
Texas has 13 state schools for people with mental and developmental problems.
The U.S. Department of Justice has been investigating allegations of abuse and neglect at the Denton State School. A 2006 Justice Department investigation found widespread abuse and neglect at Lubbock State School.
